1. INTRODUCTION

This Privacy Policy is published in compliance with the provisions of the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and any other applicable law for the time being in force in India. This document is an electronic record in terms of the Information Technology Act, 2000 and the rules framed thereunder, and does not require any physical or digital signature. This Privacy Policy governs the collection, usage, storage, processing, and disclosure of personal and non-personal data by Brandure Tap Plus, a sole proprietorship firm registered and operating in India under the name Brandure Tap Plus, having its principal place of business at Mathura, Uttar Pradesh, India (“Company”, “We”, “Our”, or “Us”). By accessing or using the website, dashboard, NFC-enabled digital business cards, WhatsApp-integrated digital stores, or any associated platform or mobile application (“Services”), you (“User”, “You”, or “Your”) agree to the terms of this Privacy Policy.

2. LEGAL ENTITY AND GOVERNING LAW

The Company operates as a sole proprietorship under the trade name Brandure Tap Plus. All matters arising under this Policy shall be governed by and construed in accordance with the laws of India, and subject to the exclusive jurisdiction of the courts at Mathura, Uttar Pradesh, India.

Any dispute or claim shall be resolved exclusively before such competent courts within said jurisdiction.

3. SCOPE OF APPLICATION

This Policy applies to all information collected through or in connection with the following: 1. The official website and administrative dashboard of Brandure Tap Plus; 2. The physical NFC-enabled PVC or metal cards sold or provided under the Brandure Tap Plus brand;

3. WhatsApp-integrated digital stores or other social or messaging-based integrations; 4. Any mobile or software application launched or operated under the Brandure Tap Plus name.

4. INFORMATION COLLECTED

The Company may collect, store, and process the following categories of information: (a) Personal Information Includes but is not limited to: Name, designation, business name, email address, contact number; Profile photo, social links, or content uploaded by the User voluntarily; Payment information (processed through secure third-party gateways); Account details necessary for digital card or store creation.

(b) Non-Personal / Technical Information Device details, IP address, browser type, access times, and log data; Analytical and usage data gathered via cookies or analytics tools. (c) User-Generated Content Any content, media, image, logo, or business information voluntarily uploaded by the User onto the Brandure Tap Plus platform or dashboard.

5. CONSENT

By using or continuing to use the Services, the User hereby expressly consents to: 1. The collection, processing, and retention of their personal and non-personal information as per this Policy; 2. The use of such information for communication, support, customization, and service enhancement; 3. The lawful transfer of such data to third parties for operational or functional purposes; 4. The cross-border transfer of data, if required, for storage or processing purposes.

6. PURPOSE AND USAGE OF INFORMATION

The Company may use the information collected for: 1. Facilitating and improving the delivery of Services; 2. Generating customized digital cards or stores for Users; 3. Processing transactions and subscriptions;

4. Sending administrative, technical, or promotional communications; 5. Complying with applicable legal or regulatory obligations;

6. Preventing fraudulent activities and maintaining service integrity.

7. DATA RETENTION AND SECURITY

The Company shall retain personal information only for such period as may be necessary for the purposes stated herein, or as required under applicable law. All reasonable technical and organizational measures shall be adopted to ensure the protection of data against unauthorized access, alteration, disclosure, or destruction. The Company uses secure, encrypted cloud servers (whether hosted within or outside India) compliant with applicable data protection standards. However, the User acknowledges that no electronic storage or transmission system can be fully secure, and the Company, its founder, or representatives shall not be liable for any unauthorized access, hacking, or data breach beyond reasonable control.

Any changes will be reflected on this page with a new effective date.

8. DISCLOSURE OF INFORMATION

The Company shall not sell or rent Users’ personal data. Disclosure may occur only in the following circumstances: To authorized vendors, contractors, and service providers engaged for operational support (hosting, payment, analytics, etc.);

When required under applicable law, court order, or government direction; To a business successor or acquirer in the event of merger, acquisition, or restructuring. All third parties handling such data are bound by confidentiality and data protection obligations.

9. USER-GENERATED CONTENT AND LIABILITY DISCLAIMER

The User shall be solely responsible for all content, data, photographs, media, and materials uploaded or displayed through the Brandure Tap Plus platform, dashboard, or digital cards.

The Company, its founder, employees, or affiliates shall not be held liable for any unlawful, misleading, defamatory, obscene, or infringing content uploaded or published by any User. The Company shall not verify or moderate user-generated content and shall act as a neutral technological intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000. Any liability arising from misuse of content or infringement of third-party rights shall rest entirely with the User who uploaded or authorized such content.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

1. The Company, its founder, employees, representatives, or affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of Services.

2. The Company shall not be responsible for data loss, delay, interruption, or breach caused by force majeure, cyberattack, or third-party service failure.

3. The founder or proprietor shall have no personal liability under any circumstances for acts or omissions performed in good faith under this Policy.

4. The total liability of the Company for any claim shall not exceed the amount paid by the User for the Services in question.

11. THIRD-PARTY LINKS AND INTEGRATIONS The Services may contain third-party integrations or links (including WhatsApp, hosting providers, payment gateways, and analytics tools). The Company shall not be responsible for any actions, omissions, or privacy practices of such third parties. Users are advised to read the respective privacy policies of those service providers separately.
